TERMS & CONDITIONS
DEFINITIONS
In this document the following words shall have the following meanings:
"Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977.
"Customer" means any person who purchases Goods and Services from the Supplier.
"Goods" means the product being purchased, i.e. ECO Animal Bedding.
"Proposal" means a statement of work, quotation or other similar document describing the Goods and Services to be provided by the Supplier.
"Services" means the services specified in the Proposal.
"Supplier" means ELITE Paper Solutions of Unit 3 & 4 Viaduct House, Merthyr Tydfil, CF48 4DR.
"Terms and Conditions" means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by the Supplier.
1. PRODUCTS OR SERVICES
1.1 | The Supplier has made every effort to display as accurately as possible the colour and images of our products that appear at the store. The Supplier cannot guarantee that your computer monitor’s display of any colour will be accurate.
1.2 | The Supplier reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. The Supplier may exercise this right on a case-by-case basis and reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of the supplier. Any offer for any product or service made on this site is void where prohibited and the supplier reserve the right to discontinue any product at any time.
1.3 | The Supplier do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
2. QUALITY, FITNESS FOR USE AND LIMITATION OF LIABILITY
2.1 The Goods are supplied for use as bedding material only and should not be used for any other purpose (either immediately or subsequent to their use as a bedding material).
2.2 The Supplier warrants that on delivery the Goods shall conform in all material respects with the specification; i.e only as animal bedding.
2.3 The risk in the Goods shall pass to the Customer on completion of delivery.
2.4 The Customer is responsible for ensuring that the Goods are used safely and as directed. They must behave sensibly and follow any safety procedures so as not to hurt or injure yourself, any animals or others.
2.5 The Goods are not suitable for consumption and the Customer must ensure that it is not consumed by any animals or any others.
2.6 The use of the Goods are entirely at your risk and we will not be responsible or liable in any way for any personal injury, death or any indirect, incidental, special and consequential damages arising out of your use or misuse of the product, including any circumstances under which the safety of the animals.
3. DELIVERY OF PRODUCT
3.1 The Customer agrees to check the Goods on arrival and to sign to confirm satisfactory delivery. If the Supplier has agreed to deliver when no one is at the delivery address to sign to confirm receipt, the Goods will be left at your risk.
3.2 If the Goods are not promptly stored in a dry environment, they may deteriorate. The Customer agrees to have arrangements for dry storage in place before delivery.
3.3 The date of delivery specified by the Supplier is an estimate only. Time for delivery shall not be of the essence of the contract and the Supplier shall not be liable for any loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods.
3.4 The Supplier will not be liable or responsible for any failure to deliver, or delay that is caused by events outside our reasonable control, including but not limited to:
(a) government lockdown due to pandemic
(b) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster
(c) impossibility of the use of public or private road networks
